ContentBuilder — Billing & Subscription Policy (v1.2)

This Billing & Subscription Policy (“Policy”) applies to all paid plans, add-ons, and usage-based services offered by SmartExpert Inc. (d/b/a “ContentBuilder”).

It is incorporated into and supplements our Terms of Use.

For plan names, included features, limits, and prices, refer to our Pricing Page.

1. Plans and Pricing Page

Our current subscription plans (Free, Creator, Team, and Enterprise), along with features, limits, and pricing, are described on the Pricing Page.

We may update plan structures, limits, and prices from time to time.

For details about notice and effective dates of such changes, see Section 7 below.

2. Subscription Cycles and Auto-Renewal

  • Subscriptions are available on monthly or annual billing cycles.
  • All subscriptions automatically renew for the same term until cancelled.
  • By subscribing, you authorize ContentBuilder and its payment processor to securely store your payment information and automatically charge fees for your subscription and active add-ons.
  • If an automatic charge fails, we may suspend or restrict access and retry the charge until payment is completed or the subscription is cancelled.

3. Add-ons, Overage, and Usage-Based Billing

  • Add-ons (e.g., Extra Credits, Extra Storage, or Connectors) are recurring monthly purchases unless cancelled.
  • If you exceed your plan limits (credits, storage, API calls, or other usage metrics), overage charges may apply at the current rates listed on the Pricing Page.
  • Usage of AI or API-based features may be billed according to model pricing or consumption metrics (e.g., per generation, per token, per minute, or per API call).
  • We may update usage pricing or metrics to reflect changes in compute costs, model versions, or available capabilities, with reasonable prior notice.
  • Workspace or organization administrators remain responsible for all usage generated within their Workspace.

4. Credits

  • “Credits” are usage units for generative or metered actions within the Services.
  • Credits are not currency, have no cash value, and are non-refundable unless required by law.
  • Credit consumption logic (e.g., “Outline — 5 credits”, “Video — 20 credits per minute”) is displayed in your billing interface and may be updated periodically.
  • Credit carryover or expiration depends on your plan. Unless otherwise stated, unused credits do not roll over to the next billing period.

5. Payments, Taxes, and Invoices

  • All prices are listed in USD, unless otherwise indicated.
  • Prices do not include applicable taxes (e.g., VAT, GST, sales tax). Taxes are calculated based on your billing address and added at checkout.
  • For payments in other currencies, conversion rates are determined by your payment provider.
  • We process payments through trusted PCI DSS–compliant payment processors (e.g., Stripe).

    We do not store full credit card details on our servers.

  • By subscribing, you authorize recurring charges via our payment processor in accordance with your plan.
  • If collection efforts become necessary, you agree to reimburse reasonable recovery costs (including attorney fees) where permitted by law.
  • We may adjust amounts charged to include any applicable taxes, duties, or currency conversion adjustments imposed by payment networks or regulators.

6. Cancellations, Refunds, and Billing Disputes

  • You may cancel your subscription at any time from your account settings. Access remains active until the end of the current paid period.
  • Unless otherwise required by law, all fees are non-refundable, including for subscriptions, add-ons, or unused credits.
  • If applicable consumer laws grant you a right to withdraw or request a refund for digital services, those rights apply as provided by law.
  • If you believe you were incorrectly charged, contact [email protected] within 14 days of the charge for review.
  • Refunds, if approved, are processed back to the original payment method only.

We may decline refund requests made after this period or arising from user error.

7. Price Changes, Plan Updates, and Billing Corrections

  • We may modify plan structures, features, limits, or prices by updating the Pricing Page and/or in-product notices.
  • For active subscriptions, we will provide reasonable advance notice (e.g., via email or in-product) before new prices take effect.
  • Continued use of the Services after the effective date constitutes acceptance of the updated pricing.
  • In the event of billing errors or discrepancies, we reserve the right to correct invoices or charges retroactively and will notify you of any corrections.

8. Trial Periods and Promotional Offers

  • Trial periods, promotional credits, and discount offers are described in their respective offers.
  • After a trial ends, your subscription may automatically convert to a paid plan with auto-renewal unless cancelled before the trial expires.
  • Promotions cannot be transferred, combined, or exchanged for cash.

9. Suspension and Termination for Non-Payment or Violation

  • We may suspend, limit, or terminate access for non-payment, chargeback, or violation of the Terms of Use.
  • Subscriptions may also be terminated for material breach (e.g., abuse, illegal activity, repeated non-payment, or exceeding plan limits).

10. Team, Workspace, and Enterprise Billing

  • For Team, Workspace, or Enterprise plans, billing responsibility lies with the organization or account owner who initiated the subscription.
  • The organization (workspace owner) manages payment methods, invoices, and user seats associated with its Workspace.
  • We are not responsible for internal cost allocations, reimbursement disputes, or seat management within your organization.
  • The organization may add, reassign, or remove users at its discretion.

11. Compliance and Legal Use

  • You may not use our Services for transactions related to restricted jurisdictions or sanctioned entities under U.S. or international law.
  • We comply with applicable export control, anti-money-laundering, and financial compliance regulations.
  • All payments are processed in compliance with PCI DSS and applicable consumer protection laws.
